ABIA Moai Games LTD. (“Moai Games”, “we”, “our” or “us”), doing business as Moai Games, creates world-class mobile games (“Games”) and operates the official website https://www.moaigames.io/ (“Site”).

This Privacy Policy describes in a transparent and straightforward manner how we collect, use, and share your Personal Data. By using our Games or Site (collectively, the “Services”), you manifest your assent to the practices described in this Policy and our Terms of Use. If you do not agree, please stop using our Services immediately.

Data Controller & Guest Mode: Moai Games acts as a “data controller” under global data protection laws, including the GDPR, UK Data Protection Act, and the Israeli Privacy Protection Law (including Amendment 13). We operate primarily in “Guest Mode.” Unless you choose to sign in via a third-party provider, your game progress is tied to your unique device identifier. We do not maintain a proprietary account system or store user passwords.

1. Information We Collect

We process information only where we have a legal basis (Contractual Necessity, Legitimate Interest, or Consent).

  • Identifiers: We collect IP addresses, Advertising IDs (IDFA for iOS, GAID for Android), and Vendor IDs (IDFV).

  • Gameplay & Usage: We track "event-based" data such as levels reached, wins/losses, in-game achievements, and session duration.

  • Technical Data: We collect information regarding your device model, operating system, language, and crash stack traces via Firebase Crashlytics.

  • Communication Data: If you contact us via support@moaigames.io, we collect your email address and any information you voluntarily include in your inquiry.

2. Strategic Data Residency & Transfers

Moai Games is based in Israel, a jurisdiction recognized by the European Commission as providing an adequate level of protection for personal data. This status ensures that data may flow between the EEA and our headquarters under high compliance standards.

  • European Data Residency: For our advanced analytics, we have specifically configured our partner, Mixpanel, to store and process data on servers located within the European Union.

  • Global Partners: Where data is processed by partners in other regions (e.g., USA), we utilize Standard Contractual Clauses (SCCs) to ensure your privacy rights remain protected.

3. Third-Party Partners and SDKs

We utilize a limited list of industry-standard partners to power our Games. We reserve the right to update this list to maintain game performance and security:

  • Infrastructure: Playfab (Microsoft), Firebase (Google).

  • Analytics: Mixpanel (EU-Residency), Google Analytics, Unity Analytics.

  • Attribution & Marketing: Appsflyer.

  • Ad Mediation: AppLovin. AppLovin acts as a mediation platform that connects to various ad networks (including Meta and Google). These networks may use tracking technologies to serve relevant, interest-based advertisements.

4. US State Privacy Supplement (CCPA/CPRA, Texas, etc.)

For residents of the United States:

  • "Sale" or "Sharing" of Data: Our use of advertising identifiers for "cross-contextual behavioral advertising" may be considered a "sale" or "sharing" of data under certain state laws. You may opt-out of this at any time via your device settings.

  • Age Ratings: In compliance with the Texas App Store Accountability Act, we provide accurate age ratings to the App Stores and rely on platform-level age signals for compliance.

  • Choice: We do not use "dark patterns" or manipulative designs to influence your privacy decisions.

5. Your Rights and Choice

  • Opt-Out: You may manage your advertising preferences via your device:

    • iOS: Settings > Privacy > Tracking.

    • Android: Settings > Google > Ads.

  • Exercise Rights: Depending on your jurisdiction, you may have the right to access, rectify, or erase your data. Because we use Guest Mode, you must provide your unique Device ID to allow us to locate your records. Requests should be sent to support@moaigames.io.

6. Children's Privacy

Our Games are not targeted at children under 16. We do not knowingly collect personal data from children. We rely on platform-level age signals provided by Apple and Google to ensure compliance with COPPA and relevant "Age Assurance" regulations.

We implement reasonable technical and organizational measures to protect your data. We retain Personal Data only for as long as necessary to provide the Services, fulfill legal obligations, or resolve disputes.
