Terms of Use

These terms and conditions ("Terms") form a binding agreement between ABIA Moai Games LTD. (“Moai Games”, “we”, “our” or “us”), doing business as Moai Games, and you ("you", or the “User”). They set the rules for your use of any of Moai Games' games and other mobile applications (“Games”), the official website https://www.moaigames.io/ (“Site”), and related services (collectively, the “Service”).

Individual Arbitration Notice: You undertake to resolve any dispute related to the Service only via final and binding individual arbitration, and you waive the right to pursue any class, collective, group, or representative claim or dispute resolution proceeding. See Section 19 below for further details, including the "Batch Arbitration" protocols.

BY ACCESSING OR USING THE SERVICE, YOU MANIFEST YOUR AGREEMENT TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, YOU MAY NOT INSTALL, ACCESS, OR USE THE SERVICE.

1. Service Eligibility

  • Global Availability: The Service is made available globally, excluding any country or territory subject to comprehensive U.S., EU, or Israeli government sanctions or embargoes.

  • Age Requirement: You must be at least 18 years of age to use the Service. If you are between 16 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

  • Proof of Eligibility: We reserve the right to request proof of age at any time and may suspend access for any User unable to satisfy these requirements.

2. Access to the Service (Guest Mode)

The Service is currently accessed primarily via “Guest Mode.” Your gameplay progress and any Virtual Items (defined below) are tied to your specific mobile device via unique device identifiers.

  • Responsibility for Progress: Because we do not maintain a proprietary account system (unless otherwise enabled via a third-party login), we cannot restore your progress if your device is lost, stolen, or reset, or if the Game is uninstalled.

  • No Multi-Device Sync: In Guest Mode, progress is limited to the device on which it was created. You assume all risk of loss for data or Virtual Items under these circumstances.

3. Virtual Items and Licensing

During gameplay, you may obtain or purchase virtual currency, points, or items (“Virtual Items”).

  • Limited License: Virtual Items are not "owned" by you. Instead, we grant you a limited, personal, revocable, non-transferable, and non-sublicensable license to use these items solely within the Game.

  • No Monetary Value: Virtual Items have no "real world" monetary value and cannot be redeemed for money or valuables.

  • Prohibited Trading: You shall not buy, sell, or trade Virtual Items or Accounts outside of the Service. Any such attempt will result in the immediate revocation of your license and termination of access.

4. Intellectual Property and User Feedback

  • Ownership: Moai Games retains all rights, title, and interest in the Games and Service Content (including graphics, code, characters, and sounds).

  • NFT Ban: You are strictly prohibited from creating, selling, or distributing any Non-Fungible Tokens (NFTs) or digital assets based on Moai Games’ intellectual property.

  • Feedback: If you provide suggestions or feedback to us, you agree that we may use such feedback for any purpose without compensation or obligation to you.

5. Restrictions on Conduct

You agree not to, and will not assist others to:

  1. Use "cheats," automation software (bots), or any third-party tools that interfere with the Service.

  2. Reverse engineer, decompile, or attempt to derive the source code of the Games.

  3. Modify any part of the Service without our express written consent.

  4. Engage in any fraudulent activity, including payment fraud or chargeback abuse.

6. Inactivity and Termination

  • Inactivity: We reserve the right to terminate or reset an Account or device profile that has been inactive for at least 365 consecutive days.

  • Termination by Us: We may suspend or terminate your access immediately if we suspect a violation of these Terms or for any other reason in our sole discretion.

7. Refund Policy

Purchases of Virtual Items are final and non-refundable, except as required by applicable law. For residents of the EU or UK, statutory withdrawal rights apply for 14 days, provided the Virtual Items have not been consumed or used within the Game. All refund requests for purchases made via the App Store or Google Play must be directed to the respective platform provider.

8. Disclaimers of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." MOAI GAMES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOAI GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO MOAI GAMES IN THE THIRTY (30) DAYS IMMEDIATELY PRECEDING THE CLAIM. IF NO PAYMENTS WERE MADE, YOUR SOLE REMEDY IS TO CEASE USING THE SERVICE.

10. Indemnity

You agree to indemnify and hold Moai Games and its affiliates, officers, and employees harmless from any loss, liability, or expense (including attorneys' fees) arising from your use of the Service or your violation of these Terms.

11. Governing Law

These Terms and your use of the Service are governed by the laws of the State of Israel, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts of Tel Aviv-Jaffa, Israel.

12. Dispute Resolution and Batch Arbitration

Please Read Carefully:

  • Informal Resolution: You agree to first contact support@moaigames.io to attempt an informal resolution before filing for arbitration.

  • Binding Arbitration: Any dispute that cannot be resolved informally shall be settled by binding, individual arbitration.

  • Batching Clause: If 25 or more similar claims are filed against Moai Games by the same counsel or a coordinated group, the claims shall be resolved in "batches" of 25. Each batch shall be resolved in a single consolidated arbitration. This protocol is intended to ensure fair and efficient resolution of multiple claims.
